General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) contain important information regarding customers’ rights and obligations in the context of distance selling contracts and electronic commerce with our company.
These GTC apply to all contracts concluded between Stefan Wölfle (hereinafter referred to as “the Seller”) and his customers.
The purchase contract is concluded with Stefan Wölfle. For any questions, returns or complaints, we are available on weekdays via email at hello@coarsee.com.
3.1 – The presentation of products in the online shop, on websites, or in printed or digital catalogues and brochures does not constitute a legally binding offer. It serves as an invitation for the customer to submit an order.
3.2 – Customers may select products from the Seller’s range and place them in a virtual shopping basket. Before submitting their request, they can amend or remove items from the basket.
3.4 – The customer will receive a written offer via email within five working days. To finalise the order, the customer must confirm the offer in writing within five working days. By doing so, the customer submits a binding declaration to purchase the items listed. The purchase contract becomes effective once the order confirmation is sent via email or upon dispatch of the goods.
3.5 – If the customer does not accept the offer within the specified period, no contract shall be formed, and the customer is no longer bound by their order.
4.1 – Prices quoted are exclusive of statutory VAT and other applicable charges.
4.2 – Delivery charges are calculated in addition to product prices and will be clearly stated in the customer’s personal offer.
4.3 – Customers are responsible for providing an accurate delivery address. Any costs incurred due to incorrect address details shall be borne by the customer.
5.1 – Delivery is available to countries within the European Union, Switzerland, the United Kingdom, and Norway. Deliveries to other countries may be possible on request.
5.2 – The standard delivery time is 8–10 weeks from receipt of payment.
5.3 – If a product is unavailable for timely delivery due to supplier delays, the customer will be notified immediately. The customer may then choose to wait or cancel the order. Any payments already made will be refunded in the event of a cancellation.
5.4 – Shipping is handled by a courier or freight forwarder appointed by the Seller.
6.1 – As all items are made to order, payment is accepted in advance only.
6.2 – Payment details will be provided in the order confirmation. Alternatively, payment can be made by invoice or via PayPal. For PayPal payments, the terms and conditions of PayPal (Europe) S.à r.l. et Cie, S.C.A. apply, available at: https://www.paypal.com/de/webapps/mpp/ua/legalhub-full?locale.x=de_DE.
7.1 – The customer may only set off claims if they are legally established or acknowledged by the Seller.
7.2 – A right of retention may only be exercised in relation to claims arising from the same contractual relationship.
In the event of a material defect, the statutory provisions on warranty apply.
9.1 – We accept unlimited liability for damages resulting from injury to life, limb or health caused by intentional or negligent breach of duty by us or our agents. This also applies to claims under product liability legislation.
9.2 – In cases of simple negligence, we are only liable for breaches of essential contractual obligations, and then only for foreseeable damages typical of the contract.
9.3 – Any further liability is excluded, including claims for damages due to tortious acts or wasted expenditure.
9.4 – These limitations also apply to our employees, representatives and vicarious agents.
The legal relationship between the Seller and customers who are acting as businesses is governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For all disputes, the place of jurisdiction is the Seller’s registered office, provided the customer is a business, a legal entity under public law, or a special public fund, or has no general jurisdiction in Germany. The Seller reserves the right to bring legal action at any other permissible venue.
The European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/. Consumers may use this platform to resolve disputes. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Right of Withdrawal
Consumers, as defined in §13 BGB (German Civil Code), have the right to withdraw from their purchase within 14 days without giving a reason, in written form (e.g. by letter or email). The withdrawal period begins upon receipt of this notice in text form, but not before the goods have been received and our statutory information obligations have been fulfilled.
The withdrawal must be addressed to:
Coarsee, Obentrautstraße 71, 10963 Berlin, Germany
Email: hello@coarsee.com
In the event of a valid withdrawal, both parties are required to return any benefits received. If the customer is only able to return the goods in a diminished state, they may be liable to pay compensation for loss in value. This does not apply if the deterioration is solely due to handling necessary to inspect the goods as would be possible in a retail shop. Goods that can be sent by post must be returned at the customer’s expense. Any reimbursement of payments must be made within 30 days of the withdrawal being received.
